The Delta State House of Assembly declared the Udu Constituency seat empty on Tuesday. This happened after Collins Ogbetamah, who represents the area, switched from the All Progressives Congress (APC) to the Nigeria Democratic Congress (NDC).
The decision came after Speaker Dennis Guwor read Mr Ogbetamah’s resignation letter. The letter was dated 19 June and informed the house about his move from APC to NDC.
After this, the Majority Leader, Emeka Nwaobi, raised a motion. He pointed out parts of the 1999 Constitution, as amended, that allowed them to declare the seat vacant. He also asked the Independent National Electoral Commission (INEC) to hold a by-election.
Lawmakers supported the motion without any disagreement. The speaker then officially announced that the seat was vacant. He confirmed that their action followed the constitutional rules about defections and vacancies.
